Rostechnadzor explains: Issues of operating forklifts

Managers of companies using self-propelled loading equipment are often faced with the question “Do I need to register a forklift?” In most cases, special equipment is used in a closed area, in a warehouse, and does not take part in road traffic. According to current legislation, self-propelled vehicles performing loading and unloading operations, equipped with an internal combustion engine with a capacity of more than 50 cubic meters. cm or an electric motor with a power higher than 4 kW are subject to mandatory registration. It is necessary to register the loader with Gostekhnadzor. This body monitors the condition of self-propelled vehicles. Failure to register may result in fines and a ban on further use of the vehicle.

Registration procedure


To register a forklift, you will need to collect a package of documents and submit it to the registration authority - the local branch of Gostekhnadzor. You can submit an application for registration of equipment remotely - through the government services portal. Registration of a forklift is possible for an individual or legal entity (organization). You can register special equipment to an individual at the place of registration. For foreign citizens, registration of equipment is carried out at the place of their temporary residence indicated in the document allowing him to stay on the territory of the Russian Federation. Equipment registration for official refugees is carried out in the same way. The driver operating the forklift must have a license with the appropriate open categories and ranks.

Where can I register a tractor or self-propelled machine?

8. State registration of equipment is carried out by the state technical supervision body at the place of application of the owner of the equipment, regardless of the place of registration of the individual, individual entrepreneur or location of the legal entity that owns the equipment, within one constituent entity of the Russian Federation.

Unlike cars, which can be registered at any traffic police department in the country, self-propelled vehicles can only be registered in the region where its owner lives (individual) or is located (legal entity). At the same time, within the region, you can select any department of Gostekhnadzor that deals with vehicle registration.

Documentation

The required documents for registering a forklift with Gostekhnadzor include:

  • passport of the self-propelled vehicle PSM (original);
  • purchase and sale or leasing agreement;
  • MTPL insurance policy (if the vehicle is capable of moving at a speed of over 20 km/h);
  • additional documents confirming the transfer of ownership (for example, a transfer and acceptance certificate);
  • power of attorney for the owner’s representative who will register the forklift;
  • application with a mark and seal from the military registration and enlistment office.

The legal entity must additionally provide a copy of the constituent documents (Charter, INN, State Registration Number, KPP, OGRN) and an order for registration.

Deadlines

Registration of the forklift must be completed within 10 working days from the date of transfer of ownership of the equipment. During the specified period, it is necessary to collect documents and submit the equipment for inspection to a representative of Gostekhnadzor, who will check the numbers of the machine and main components with those indicated in the documents.

Refusal to register vehicles by Gostekhnadzor is possible in the following cases:

  • an incomplete package of documents was provided;
  • the MTPL policy is expired or invalid;
  • The equipment owner’s passport has expired;
  • forgeries were found in the documents provided;
  • discrepancy between the license plates of the units present on the vehicle and those indicated in the documentation.

The refusal is issued on an official form and issued to the owner of the forklift. You can appeal the decision of Gostekhnadzor and file a response within 15 days.

Is a vehicle inspection required during registration?

63. When state registration of equipment, changes in registration data, issuance of certificates of state registration of equipment to replace lost or unusable equipment, duplicates of equipment passports, owners are required to present the equipment for inspection in order to check the compliance of the main components of the equipment with registration data.

When submitting an application for state registration of equipment or to make changes to the registration data of equipment in the form given in Appendix No. 1 or 2 to these Rules, using the Unified Portal, the place and time of inspection are chosen by the applicant independently, but no later than the expiration of the mandatory period for state registration of equipment specified in paragraph 5 of these Rules.

Inspection of tractors and self-propelled machines is mandatory in all cases when Gostekhnadzor issues documents for the specified equipment.

The inspection is carried out even when the owner of the tractor does not change and only the issuance of a duplicate of the lost document is required.

20. Inspection of equipment is carried out by a state engineer-inspector of the state technical supervision body at the place of filing the application for state registration of equipment or the location of the equipment, and in the case of inspection of a group of equipment - at the location of the equipment.

When inspecting equipment, it is identified and verified that there are no signs of alteration, concealment, or destruction of the factory identification number of the equipment or the number of the main component of the equipment.

When inspecting equipment, the compliance of its design with the submitted documents is checked, and, if necessary, the compliance of changes made in the design of the equipment with documents on the compliance of the equipment with the changes made in its design with safety requirements is checked.

Upon completion of the inspection of the equipment, a note about its result is included in the application for state registration of the equipment. The validity period of the equipment inspection results is 30 calendar days from the date of its conduct.

Inspection of equipment can be carried out either by Gostekhnadzor authorities . or at the location of the equipment. Naturally, in the second case, you should contact Gostekhnadzor in advance and agree with the inspector on the time and place of inspection of the tractor or self-propelled machine.

During the inspection, the Gostekhnadzor employee checks:

  • VIN - number and engine number;
  • that the design of the equipment corresponds to the submitted documents (there are no design changes);

The inspection results are valid for 30 days . During this time, the owner must contact Gostekhnadzor to register and obtain numbers.

Penalties for evasion


According to Art. 19.22 of the Code of Administrative Offenses of the Russian Federation provides for penalties for operating a front-end loader or forklift equipment without registering the equipment. For failure to pay transport tax and technical inspection, a warning is first issued. If it is ignored, the owner of the equipment will face a fine:

  • for an individual - 1000-1500 rubles;
  • for a legal entity - 5000-10000 rubles;
  • for an official - 2000-3500 rubles.

Imposing a fine does not relieve you from the need to register the vehicle - you will still have to register the loader. Registration is not required only for equipment that was purchased for the purpose of further resale.

Despite the economic situation on the territory of the Russian Federation, due to the huge amount of daily cargo turnover, there is a high growth in economic activity. To increase productivity, many companies are starting to think about purchasing special equipment.

Loaders are the most popular among special equipment. A loader is usually called a lifting and transport machine designed to lift, grab, move and stack cargo.

Such equipment is usually classified according to the type of load being processed, the chassis, the type of drive, as well as the nature of the operations performed.

Loaders can be equipped with either a diesel engine or an electric motor, or they can be gas-powered. There are fork, single-bucket, multi-bucket, each can be upgraded with additional equipment depending on the specifics of the work being performed.

When purchasing equipment, the operating organization asks the question: “ Is it necessary to register the equipment with government agencies ?” The answer is clear, yes, it is necessary. This requirement is regulated by the Rules for the state registration of tractors, self-propelled road-building and other machines and trailers for them by the state supervision bodies over the technical condition of self-propelled machines and other types of equipment in the Russian Federation (Gostekhnadzor), approved by the Ministry of Agriculture and Food of the Russian Federation dated January 16, 1995 and Government Resolution dated August 12 .94 N 938 “On state registration of motor vehicles and other types of self-propelled equipment on the territory of the Russian Federation.” However, it should be taken into account that Gostekhnadzor is subject to mandatory state registration of self-propelled vehicles with an internal combustion engine displacement of more than 50 cubic meters. cm or an electric motor power of more than 4 kW.

In accordance with Decree of the Government of the Russian Federation No. 938, any equipment with an internal combustion engine with a volume of more than 50 cubic meters. cm, as well as electric moving units with a power exceeding 4 kW, are transport and are subject to registration for permission to operate.

A logical question would be: “ What sanctions apply if a front loader is not registered?” How will this be detected if the equipment is located in a closed area?” In accordance with Art. 19.22 of the Code of Administrative Offenses of the Russian Federation, violation of the rules for registering vehicles of all types entails the imposition of an administrative fine on citizens in the amount of one thousand five hundred to two thousand rubles; for officials - from two thousand to three thousand five hundred rubles; for legal entities - from five thousand to ten thousand rubles.

A fine will be issued each time a violation is detected. As for closed areas, Gostekhnadzor conducts scheduled “raids” in order to identify violations in the field of operation of self-propelled vehicles. Based on the order that the Gostekhnadzor inspector will have with him, he has the right to enter the territory in order to carry out certain actions specified in the existing order. In addition, in the event of an accident, failure to register the forklift with Gostekhnadzor will entail additional sanctions and adverse consequences for the owner. Here we can even recall the incident in Pulkovo, where the equipment was not properly registered, technical inspections were not carried out, all this led to criminal cases and other unfavorable issues. In addition, if a company does not carry out scheduled technical inspections for a long time, this is also a reason for inspections.

Also, registering a forklift with Gostekhnadzor is a kind of guarantee against vehicle theft, since equipment with a license plate can be identified, unlike equipment without any documents at all.

Problems with deregistration of a forklift

To deregister loading equipment, you must prepare the following package of documents:

  • Passport for self-propelled vehicle PSM (original);
  • car certificate confirming ownership;
  • application form (for individuals or organizations);
  • document confirming the identity of the owner of the vehicle;
  • MTPL insurance policy (current);
  • a standard license plate removed from the forklift.

The need for deregistration arises when the owner’s details are changed, written off or sold.

How to move equipment to another region?

It was discussed above that the previous owner can stop registering a self-propelled vehicle, and the new owner must register it in his own name. However, the situation becomes more complicated if the equipment is purchased in a “foreign” region and needs to be transported. In this case, the buyer needs to obtain transit numbers :

For equipment transported to the place of registration from organizations that manufacture this equipment and trade organizations, state registration plates “TRANSIT” are issued by these organizations after they are received by the state technical supervision authority at the location of these organizations.

For equipment transported to the place of registration by its owners, state registration plates “TRANSIT” are issued by state technical supervision authorities at the place of application of the owner of the equipment.

Transit numbers for transportation to the place of registration can be obtained from any department of Gostekhnadzor in any region.

How does the tax office check registration?

Representatives of government bodies conduct inspections at enterprises in order to identify violations and incorrect calculation of depreciation. Particular attention is paid to the availability of registration documentation for special equipment. This is also due to the possibility of accidents at work. If they occur when using unregistered equipment, the owner will be fined. The procedure for registering a forklift will not take much time and will not cost much. At the same time, you will be protected from troubles, including from the tax authorities.

How to submit documents for registration to Gostekhnadzor?

7. The application of the owner of the equipment or his representative for state registration of the equipment and the documents attached to it can be submitted by the owner of the equipment or his representative personally to the state technical supervision body.

The specified application and documents can be submitted by the owner of the equipment or his representative to the state technical supervision body using the federal state information system “Unified portal of state and municipal services (functions)” and (or) regional portals of state and municipal services (hereinafter referred to as the Unified Portal) and signed using a simple electronic signature key without the need to submit such an application in another form. The state technical supervision body informs the applicant about the progress of the service through notifications in the personal account on the Unified Portal.

The rules offer 2 options for submitting an application to Gostekhnadzor:

  • in person;
  • in electronic form through State Services.

Forklift (electric forklift) registration: evasion and consequences

Nevertheless, cases when enterprises, purchasing warehouse equipment, try to bypass the forklift registration procedure are not so rare. Why register a forklift or electric forklift if it is not a participant in road traffic, since it works only in the territory under the jurisdiction of the enterprise? The logic is this: if the forklift has not been registered with Gostekhnadzor, then, therefore, the transport tax may not be paid, and it is not necessary to undergo MOT.

But if you don't register your forklift, you'll get into trouble. For example, during the next raid by representatives of Gostekhnadzor. In accordance with clause 3 of the Decree of the Government of the Russian Federation “On state registration of motor vehicles and other types of self-propelled equipment,” registration of forklifts with Gostekhnadzor is an obligation, not an optional action.

The situation is similar with the issue of paying transport tax. According to Art. 358 of the Tax Code of the Russian Federation, even if the registration of a forklift or electric forklift was not carried out within the required time frame, this is not a reason to evade paying the transport fee. Therefore, representatives of the tax inspectorate have every right to include equipment in the tax base of the enterprise starting from the period in which the owner was required to register it by law.
